This Agreement governs your use of Industrial Performance Services and its Services, including the Mobile Web App, Forms, and Website, in your country of residence. You need compatible hardware, software, and internet access. Your Industrial Performance Services ID may be essential for accessing content and services, and you’re responsible for its security. Unauthorized use of your account isn’t Industrial Performance Services’ liability. You must adhere to usage rules, and any breach is considered a violation of the agreement. Industrial Performance Services may monitor your usage. Downloaded content may have limits and expiration dates. Redownloading is possible only for content still offered. Services and content availability depend on your location. Industrial Performance Services may change terms at any time. Third-party materials linked from the Services aren’t Industrial Performance Services’ responsibility. The Services and content are protected by copyright laws, and you’re granted limited rights. Industrial Performance Services trademarks and logos are protected. You agree to indemnify Industrial Performance Services against any claims related to your use of the Services. The agreement is governed by the laws of Texas. If you’re outside the U.S., local laws may apply. This agreement constitutes the entire understanding between you and Industrial Performance Services.
Introduction
This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and [The IPS Group] (“Company”) governing the use of the Company’s website content and documents. By accessing or using the website content and documents, you agree to be bound by the terms of this Agreement.
License Grant
The Company grants User a limited, non-exclusive, non-transferable license to view and print the website content and documents solely for personal or internal business use. The Company disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with the use or inability to use the website content and documents.
Governing Law
